Back in May of 2018, a UPS truck driver ran a red light and hit another car that was driven by the Plaintiff who was 13 weeks pregnant. The Plaintiff had to seek emergency medical treatment. Her son was born in October of 2018 with hypotonia, which is low muscle tone, and would later on be diagnosed with schizencephaly, permanent brain damage.
The UPS truck driver admitted to speeding before the collision and that UPS had been aware before they hired him in 2010, that he had been charged with possession of crack cocaine and had a history of drug abuse. UPS was also aware that the driver had recently been in a drug rehabilitation program after using crack cocaine in February of 2018 and had completed the rehabilitation program just five days before the crash.
According to trial testimony, even after the crash, UPS still did not test the driver for drugs. The Missouri jury awarded the Plaintiff’s family $75.3 million.
