How Poorly Regulated is the Commercial Trucking Industry

The large amount commercial drivers currently designated with a “prohibited” status is in excess of 175,000 drivers. These drivers have been designated as prohibited by the Federal Motor Carrier Safety Administration’s (“FMCSA”) Drug & Alcohol Clearinghouse. The Clearinghouse program, which began in 2021, is soon to enter its second phase, “Clearinghouse II,” in which it will begin to remove these disqualified drivers from our roadways. This will be accomplished by state driver licensing agencies, as the FMCSA is forcing them to take action against these dangerous drivers.

The fact that so many unqualified, dangerous drivers are on the road with us every day is a symptom of poor regulation in the trucking industry. Indeed, it is because of lack of regulation like this that trucking accidents are a daily occurrence in Texas.
