Supreme Court of Texas Reviews $100M Verdict Against Top Trucking Company

In December 2014, the Blake Family was traveling on a Texas roadway when they crossed over the median and collided with a Werner Enterprises 18-wheeler. The result of this collision was the death of one of the Blakes’ children and significant injuries to the three other passengers in the vehicle. The case was tried in front of a Harris County jury, which found that the insufficient training of the Werner Enterprises driver caused the collision. The Blake family was awarded $89.7 million. Werner Enterprises then appealed, claiming that the driver of the 18-wheeler could not have avoided the collision. The 14th Court of Appeals affirmed the verdict of the trial court and awarded $100 million to the Blake Family. Werner Enterprises subsequently filed an appeal with the Texas Supreme Court, supported by additional briefs from the Texas Trucking Association, the U.S. Chamber of Commerce, and the American Trucking Association. The briefs aim to halt the growing trend of substantial personal injury verdicts against trucking companies. Oral arguments are currently set for December 3, 2024.
