A Philadelphia jury awarded $68.5 million to the widow of Siarhei Marhunou, a 38-year-old construction worker who died in a fatal fall at a luxury townhouse development in 2021. The verdict came after a four-day trial in the Court of Common Pleas.
Marhunou fell approximately 50 feet from an unsecured fifth-floor balcony at 2330 Sansom Street in Philadelphia’s Fitler Square neighborhood. At the time of the incident, he was installing siding at the five-unit townhouse development. The site was being developed by Ori Feibush through multiple affiliated companies, with OCF Construction, LLC serving as the general contractor.
The lawsuit, filed by Marhunou’s widow Hanna on behalf of herself and their three-year-old son, alleged negligence and multiple OSHA safety violations. Key evidence showed the development company failed to implement required fall protection measures, which are mandatory for work conducted more than six feet above ground.
Attorneys representing the family successfully argued that OCF prioritized profits over worker safety and used complex corporate structures to shield developers from responsibility. The verdict represents a significant ruling on construction site safety and corporate accountability in Philadelphia’s development sector.
