
The family of Jose Wilfredo Perez Jr., a contractor who tragically died after being exposed to toxic hydrogen sulfide gas, has filed a lawsuit against PEMEX Deer Park refinery, seeking accountability for the fatal incident. The October 10 gas leak, which critically exposed dozens of workers and led to a shelter-in-place order for nearby residents of Deer Park and Pasadena, has raised significant concerns over industrial safety practices.
The lawsuit alleges that Perez, who was working in the SR8 unit of the refinery when the leak occurred, was exposed to military-grade toxicity levels due to the refinery’s inadequate safety measures. The suit claims that PEMEX failed to install or maintain proper warning systems to alert workers in real-time, leading to a preventable and tragic outcome.
In their legal action, Perez’s family is seeking damages of at least $1 million for wrongful death, premises liability, and gross negligence. Attorney Benny Agosto, Jr., representing the family, emphasized the role of lax safety protocols in Perez’s death, pointing out that a more robust safety system could have averted the loss of life.
“This catastrophic release led to life-threatening injuries for several workers, a shelter-in-place order, and the tragic deaths of two individuals,” Agosto said in a statement.
