
Recently, a wrongful death lawsuit was filed resulting from the tragic death of Dustin Patino on June 29, 2024. The lawsuit names several defendants, including Trojan EV and the Bentwood County Country Club.
On June 29, 2024, Dustin Patino and Emilie Krieger were drinking at the pool bar in the Bentwood County Country Club. As the suit alleges, despite their obvious intoxication, Krieger was allowed to leave the Country Club and operate a golf cart, manufactured by Trojan EV to drive home. With Krieger driving and Dustin in the rear-facing back seat, the ride continued without incident until Krieger attempted to turn into a driveway. At that point the armrest and hip restraint failed causing Dustin to be ejected from the vehicle. He suffered from life threating injuries including fractured skull and died days after the incident. After failing sobriety tests and undergoing a breathalyzer, Krieger was arrested for intoxicated assault.
The father of the deceased, Juan Patino, has now filed suit claiming Bentwood Country Club violated the Texas Dram Ship act in overly serving Kreiger, product liability against Trojan EV for the defective armrest and hip restraint, and negligence against Kreiger for her failure to control the vehicle.
