
A mental health worker has been arrested for allegedly sexually assaulting a woman while at her Houston apartment in May of 2023, during a mental health session. The mental health worker was an employee of True Mental Health Company at the time of the attack; however, True Mental Health Company has yet to comment on their former employee’s arrest.
As the individual’s employer, True Mental Health Company had an affirmative duty to ensure that its employees, such as the accused individual, would not pose a danger to the interacting public. Employers, such as True Mental Health Company, can be held liable for the criminal actions of their employees if the employer knew or should have known, by way of a simple background check, that the employee would likely commit criminal conduct, such as sexual assault.
